Applicable conditions
1.1 These terms and conditions of sale apply to all purchases on prxpeel.eu. Operated by: Leonica Sp. z o.o., Stefana Batorego 18 / 108, 02-591 Warszawa, Poland. TAX ID (NIP): PL5272789642.
1.2 Covers all Products (cosmetics, medical devices, etc.).
1.3 Primarily for professionals. Private individuals may only purchase products permitted for consumer sale.
Orders
2.1 Orders processed within 48 hours.
2.2 Initial email is an overview, not a binding confirmation.
2.3 Binding agreement starts upon "Order Confirmation" (shipment notification/invoice).
Availability of Products
3.1 No guarantee of constant stock. Alternative products or cancellation offered if unavailable.
3.2 Sole remedy for unavailability is a refund of any payments made.
Customer information
4.1 Customer is responsible for correct VAT, billing, and shipping details.
Delivery and delay
5.1 Dispatch: Same day or next working day for in-stock items.
5.2 Carriers: DHL or DPD (1–7 working days).
5.3 Delivery within the European Union (13 supported countries) usually takes 1–5 working days.
5.4 If delayed by >6 days from dispatch time, the remedy is a credit note or refund.
5.5 No liability for incorrect addresses provided by the Customer.
Price and payment
6.1 Prices exclude VAT and delivery costs (added at checkout).
6.2 Prices subject to change before Order Confirmation.
6.3 We reserve the right to correct obvious pricing errors.
6.5 Payment must be made prior to order processing.
6.6 Prices in EUR. We accept Visa, MasterCard, and others.
Compliance with applicable laws and regulations
7.1 Leonica Sp. z o.o. is a wholesaler. Customer is responsible for local compliance and permits.
7.4 Customer is responsible for post-marketing obligations (market surveillance, adverse events).
Defects
8.2 Defects must be reported in writing within 3 days of receipt.
8.4 Remedy: Price reduction, repair, replacement, or refund at our discretion.
8.6 Refunds issued to the original payment method.
Products damaged in transit
9.1 Claims for damage must be reported within 3 days of receipt to contact@prxpeel.eu.
9.2 Must include photos of outer box, inner packaging, and product.
Liability
10.1 Governed by Polish law.
10.3 Total liability limited to the purchase price of the specific products.
10.4 Claims barred 3 months after delivery.
Third-party rights
11.1 No liability for IP infringement by the Products.
Product liability
12.1 Liability for bodily injury only to the extent required by mandatory law.
12.5 Venue for product liability claims follows the rules below in clause 17.
Adverse event reporting and recall
13.1 Adverse events must be reported to us within 5 days.
Taxes and other payments
14.1 Customer is responsible for all local taxes and duties in the recipient country.
Returning of goods
15.1 Customers may return goods within 30 days (extended window).
15.4 Refunds processed within 14 days of receiving the return.
15.6 Return Shipping: For our 13 supported delivery countries, return shipping is Free of Charge when using our provided labels.
Extraordinary circumstances
16.1 Force Majeure clause (natural disasters, strikes, pandemics, etc.).
Governing law and venue
17.1 Governed by Polish law, excluding CISG.
17.2 Any disputes shall be settled by the ordinary courts in Warsaw, Poland.
17.3 Any arbitration, if applicable, shall be conducted in accordance with the rules of the Polish Chamber of Commerce (KIG). The place of arbitration shall be Warsaw, Poland.
